If I have a Will is there need to do a probate?

In practicing law over the past 14 years, there is a common misconception that if a person has a Will then there is no need to do a probate.

In Florida, in order to transfer legal title to assets and property, the person’s estate, whether they died with a Will or without one, must go through the probate process.  In some cases, depending upon how assets are titled and whether beneficiaries were  designated in certain assets, a probate may not be necessary.

At Whibbs Stone Barnett, we can assist you with the probate process if you have had a loved one pass away.  We can also assist you with proper estate planning tools in order to avoid probate or advising you on how to make sure assets are easily transferred upon death.
