If I have a Will is there need to do a probate?

In practicing law over the past 14 years, there is a common misconception that if a person has a Will then there is no need to do a probate.

In Florida, in order to transfer legal title to assets and property, the person’s estate, whether they died with a Will or without one, must go through the probate process.  In some cases, depending upon how assets are titled and whether beneficiaries were  designated in certain assets, a probate may not be necessary.
